If the owner, builder or contractor considers the construction of a sidewalk impractical for any reason other than those listed in HRMC 15.16.020, such owner, builder or contractor may appeal the decision of the City Engineer to the City Planning Commission, and the City Planning Commission shall recommend to the Council whether a permit and certificate of noncompliance shall or shall not be granted, and the Council may thereupon grant a permit and certificate of noncompliance.
